If your child receives, or may be eligible for, special education services under the Individuals with Disabilities Education Act (IDEA), federal law gives you specific rights. These rights are called “procedural safeguards.” Ririe Joint School District No. 252 must give you a full copy of the Procedural Safeguards Notice at least once each school year, and also when your child is first referred for evaluation, when you ask for a copy, and the first time you file a complaint.
Your rights as a parent
- To be a full member of the team that makes decisions about your child’s evaluation, eligibility, and program (IEP).
- To give or refuse written consent before your child is evaluated or first provided special education services.
- To request an evaluation at any time, at no cost to you, and to ask for an Independent Educational Evaluation (IEE) if you disagree with the school’s evaluation.
- To receive prior written notice before the school proposes or refuses to change your child’s identification, evaluation, or placement.
- To review and obtain copies of your child’s education records.
- To receive notices and explanations in your native language or preferred mode of communication, with an interpreter provided at no cost.
- To resolve disagreements through mediation, a state complaint, or a due-process hearing — and to “stay put” in the current placement while a due-process dispute is pending.
